Used Machinery – Legal Terms and Conditions
- Condition of Goods
The machinery offered for sale is pre-owned (“used”) and may exhibit signs of prior use, including cosmetic wear. Unless otherwise specified, all items are sold in operational condition and function as intended. Certain items may have been showroom models or customer returns. - Inspection Rights
In the absence of a detailed written description of any imperfections, the buyer is entitled and encouraged to conduct an inspection of the machinery prior to purchase. By completing the purchase, the buyer acknowledges having had the opportunity to inspect and accepts full responsibility for the choice and suitability of the purchased item. - Sales Conditions
All deliveries are subject to the standard Ex Works (EXW) terms and conditions of FHI The Netherlands, irrespective of whether such conditions have been expressly provided to the buyer. - Acceptance “As Is”
Used machinery is sold and accepted by the buyer strictly on an “as is, where is” basis, without any warranty or guarantee, unless expressly agreed otherwise in writing. Any exceptions, modifications, or additional warranties must be explicitly recorded in a written agreement signed by both parties prior to delivery. - Specifications and Warranty
The acquisition of machinery is based solely on the manufacturer’s original technical specifications. Any functional or performance guarantees commence prior to transport. The seller shall not be liable for design defects, manufacturing errors, or licensing issues that may affect the machine’s functionality. Such matters are expressly excluded from any warranty coverage. - Liability and Risk
The seller accepts no liability for concealed shipping damage or technical deviations arising from modifications or special configurations, unless otherwise agreed in writing. Risk transfers to the buyer upon collection or shipment as per EXW terms. - Errors and Misprints
The seller accepts no responsibility for typographical errors, misprints, or inaccuracies in advertisements or listings. Such errors shall not constitute grounds for withdrawal, cancellation, or claims. - Binding Orders
All quotations and offers are non-binding until confirmed in writing by the seller. Upon order confirmation, including full company details, the agreement becomes legally binding on the buyer.
